Haryana likely to notify RERA by July 15

Having put in place an interim authority much ahead of the central act, the Haryana government will notify the Haryana Real Estate Regulation Authority (HRERA) Act 2016 by July 15. The Union government had notified that the Real Estate Regulation Authority (RERA) Act should be in force from June 1.

The act assumes importance in Haryana since it has a history of land scams involving influential persons and politicians. Amidst allegations of residents’ associations that Haryana government had diluted some issues vis-a-vis interests of existing buyers in favour of builders, the state government invited objections on the draft rules after RERA was passed in the assembly last year.

Meanwhile, the government has convened a meeting with the officials of the Union government on July 8 before rolling out the act in the state.

The government received 1,800 objections from stakeholders to the proposed act. Some of the objections were from existing subscribers of housing schemes launched by builders who are yet to be allotted dwelling units.

According to draft rules of the state, the projects in which builders had applied for the occupancy certificate (OC) were kept out of the purview of RERA. There were some issues related to floor-area ratio (FAR) as well.

Principal secretary to the Haryana chief minister R K Khullar said officials of the town and country planning department were in the process of compiling the objections received so far. “We are the first state to put an interim authority in place ahead of the central act. The authority is getting complaints and taking measures as well. For the final notification, we intend to make certain changes on the basis of the objections. On July 8, the draft will be discussed with Union government officials. Meanwhile, we have also requested the Chief Justice of the Punjab and Haryana high court about his convenience or deployment of his representative who could be part of the committee to select chairman and members of the authority. We are hopeful of having full enforcement by July 15,” said Khullar.
